 A Quick Guide

 The Agency Worker Regulations (AWR) were introduced to provide temporary workers, including supply teachers and teaching assistants, with certain rights and protection.  The primary role of the regulations are to ensure that temporary workers receive equal treatment in terms of pay and working conditions as permanent employees.

AWR comes into force when a worker has completed a qualifying 12 week period with a particular hirer.   The period of hire does not have to be continuous, school holidays are not counted in the 12 week period so a week in July and a return visit for a days supply in September will class as two weeks toward the AWR count.  The clock resets when there is a working period of more than 6 weeks when the worker does not visit the hirer.

How does this affect me financially?

Upon completion of the 12 week qualifying period, according to AWR legislation, the Agency worker may subsequently be paid what the hirer would pay the worker as a permanent member of staff.  It is important to note that following the amendment to School Teachers’ pay and conditions in 2013 which removed portability of salary the hirer is not required to match a teachers previous pay scale but to pay the scale that they would pay that role at for any permanent member of staff.

What happens when I reach AWR?

When a worker meets the qualifying 12 weeks working for a particular hirer West Country will contact the school or MAT and ask them to review the salary that is paid for the role for placement on the Main Pay Scale.  It sometimes takes a couple of weeks for schools to advise us the new scale but any payment increase will be backdated to week 13 of the placement.

Who is responsible for tracking AWR?

It is the responsibility of the worker, the hirer and the agency to ensure that AWR is complied with – if you think that you are near, or have reached, AWR in a location you are teaching at please call us and we will provide you with an update.
